Terms of Service

Welcome to CheapHost.ca. These Terms of Service ("Terms") govern your use of our website, hosting services, VPS services, cloud infrastructure, domains, managed services, and related products ("Services"). By using our Services, you agree to these Terms.

Eligibility

You must be at least 18 years old or the legal age of majority in your jurisdiction to use our Services.

By using our Services, you confirm that you can legally enter into a binding agreement, all information provided is accurate, and you will comply with applicable laws and regulations.

Services Provided

CheapHost may provide shared hosting, VPS hosting, dedicated servers, cloud hosting, domain registration assistance, DNS management, email hosting, managed IT services, website maintenance, backup solutions, and security and monitoring services.

Services may change, improve, or be discontinued without prior notice.

Account Responsibilities

You are responsible for maintaining account security, protecting passwords and API keys, all activities under your account, and keeping billing information current. You must immediately notify us of unauthorized access or security breaches.

Acceptable Use Policy

You agree not to use our Services for illegal activities, malware distribution, phishing or fraud, spam or unsolicited emails, hosting copyrighted content without permission, DDoS attacks or abusive traffic, cryptocurrency mining without written approval, adult or prohibited content violating Canadian law, unauthorized penetration testing, or activities that disrupt network stability.

We reserve the right to suspend or terminate services violating this policy.

Resource Usage

Clients must use server resources responsibly. Excessive CPU or RAM consumption, network abuse, storage misuse, automated abusive processes, or activities affecting other customers may result in service suspension.

Dedicated resources may still be subject to reasonable network and abuse limitations.

Billing and Payments

Payment Terms

Services are billed in advance. Monthly and annual billing cycles may apply. Failure to pay may result in suspension or termination.

Taxes

Applicable Canadian taxes including HST/GST may be added where required by law.

Refunds

Unless otherwise stated, domain registrations are non-refundable, custom setup fees are non-refundable, dedicated server deployments may be non-refundable after provisioning, and refund eligibility for hosting plans may be limited to promotional guarantees.

Service Availability

We strive for high uptime but do not guarantee uninterrupted service. Scheduled maintenance, upgrades, emergency security work, third-party outages, and force majeure events may affect availability.

Backups

While CheapHost may provide backup services, clients remain fully responsible for maintaining independent backups of their data. We are not liable for data loss, corruption, failed backups, or restoration delays.

Suspension and Termination

We may suspend or terminate Services without prior notice if Terms are violated, payments are overdue, abuse complaints are received, security threats are detected, or legal compliance requires action.

Upon termination, access to Services may be removed and data may be permanently deleted after a retention period.

Intellectual Property

All branding, logos, infrastructure systems, website content, and software owned by CheapHost remain our intellectual property. Clients retain ownership of their hosted content and data.

Limitation of Liability

To the maximum extent permitted by law, CheapHost shall not be liable for lost profits, data loss, service interruptions, indirect or consequential damages, business interruption, or security incidents beyond reasonable control.

Our maximum liability shall not exceed the amount paid by the customer for the affected service during the previous 3 months.

Indemnification

You agree to indemnify and hold harmless CheapHost from claims, damages, liabilities, and legal expenses arising from your use of the Services, violation of these Terms, violation of third-party rights, or illegal hosted content.

Privacy

Your use of the Services is also governed by our Privacy Policy.

Third-Party Services

We may use third-party providers including data centers, payment processors, domain registrars, CDN providers, and cloud infrastructure vendors. We are not responsible for outages or failures caused by third-party systems.

Governing Law

These Terms shall be governed by the laws of Ontario and the laws of Canada applicable therein. Any disputes shall be handled in the courts of Ontario, Canada.

Changes to Terms

We may update these Terms at any time. Updated versions will be posted on CheapHost.ca. Continued use of Services after changes constitutes acceptance of the updated Terms.
